Criminal Records and Expungement in Virginia

Fairfax Lawyer for Adult and Juvenile Defendants

If you've been charged with a crime, the prospect of having a criminal record may be one of your biggest concerns. A criminal conviction can change your life. Even if you are not convicted, you might not be able to obtain an expungement of your criminal record.

I'm attorney Lance D. Gardner. Based in Fairfax, I have more than 25 years of experience helping clients throughout Northern Virginia avoid and reduce the severity of criminal records. If you're facing criminal charges, don't hesitate to contact me to schedule a free consultation.

What Are the Consequences of a Criminal Record?

If you are convicted of a crime, your resulting criminal record may turn out to be one of the most damaging consequences of your conviction. Whether or not you receive a jail sentence, your criminal record could have an impact on extremely important parts of your life, such as your:

  • Prospects for getting and keeping a job in your chosen profession
  • Eligibility for scholarships and financial aid from the state or federal government
  • Security clearance for government facilities
  • Right to possess firearms
  • Right to vote in Virginia

In Virginia, even a juvenile can end up saddled with a long-term criminal record. A misdemeanor juvenile conviction remains on your record for five years or longer, and a felony record is permanent whether you are tried as a juvenile or as an adult.

Are You Eligible for Expungement?

Even if you are acquitted of a crime or the charges are dropped, you can still end up with a criminal record. However, in these cases, expungement may be an option. Expungement is not automatic and can be denied, especially if you have been convicted of other crimes.

If you have criminal charges on your record that you were not convicted of, I can help you determine whether you may be successful at sealing your criminal record through the expungement process. Contact me today to discuss your options.
